However, I highly doubt that much would be done to Kawamura/CDFA under the Whistleblower Act nor would the LBAM spraying stop.

An attorney would provide an opinion letter regarding all of one&#039;s legal rights and options available under the circumstances.  Time is of the essence to see an attorney since some tort laws give you 6 months - 1 year to file a lawsuit under &quot;Tort&quot; law.  A tort is best defined as a civil wrong which the victim seeks remedy for, in the form of some kind of damages, which may include recovery of attorney fees and costs.

If there are no laws availble to file litigation there is always Small Claims Court.  This would allow one to recover and seek reimbursement for medical expenses, lost wages, etc. One can receive up to $7,500 in California&#039;s Small Claims Court.  There is a Small Claims Court in every California County.

If all 643+ people filed in Small Claims Court at the same time, CDFA&#039;s attorneys would be swamped since they would need to attend 643+ individual Small Claims Court hearings.  If Kawamura/CDFA Attorneys do not show up in Small Claims Court, one automatically wins.  

643 x 7,500 = $4,822,500.00

This amount of money would certainly make the State of California sit up and stop the spray.</description>

I so hope people are doing this.

One of the things that has been a little disconcerting and puzzling to me is that, despite the fact that CDFA has now twice been convicted of breaking the law, they have not been penalized in any way.

I spoke with someone yesterday who explained that criminal charges would need to be brought against them in order to incur monetary penalties and jail time. 

So, my guess is that lawsuits wherein the parties were injured would be criminal charges? I am afraid I am poorly educated regarding these types of legal efforts, but, like you, I hope they are being made.

CDFA has not just broken CEQA...they have injured men, women, children and infants. There must be a reckoning with this.
